TERMS AND CONDITIONS

The Terms and Conditions below set out the general conditions of sale applicable in our online shop available at http://pamiatkizpolski.pl, operated by Pamiątki z Polski Jakub Dyjak, 05-220 Zielonka, Poniatowskiego 109, NIP: 524-240-63-46, REGON: 146870080. The business activity is registered in the Centralna Ewidencja i Informacja o Działalności Gospodarczej (CEIDG) (Polish Central Register and Information on Business Activity), maintained by the minister competent for economic affairs.

1. Scope of application of the Terms and Conditions

These Terms and Conditions apply to all orders placed through our online shop. The offer of our online shop is intended exclusively for Consumers.

Pursuant to Article 22 of the Kodeks cywilny (Polish Civil Code), a Consumer is a natural person performing a legal transaction with a trader which is not directly connected with their business or professional activity.

2. Conclusion of the contract

The contract of sale is concluded with Pamiątki z Polski Jakub Dyjak.

The presentation of products in our online shop constitutes an offer to conclude a contract of sale. In order to conclude the contract, you should add the selected products to the shopping basket and place an order. The shopping basket and the data entered in the forms may be modified before the order is placed, using the available functionalities and the messages displayed during the ordering process.

By clicking, on the order summary page, the button confirming and finalising the order, you place a binding order for the products contained in the shopping basket. The contract of sale is concluded at the moment your order is received and registered in the IT system of our online shop. After placing the order, you will receive an e-mail from us confirming the order and the conclusion of the contract.

3. Language and rules on recording the contract

The contract of sale may be concluded in Polish

We retain the content of the contract and send you by e-mail the details of the order together with our Terms and Conditions. You may also check information concerning your orders via your customer account. The Terms and Conditions are also made available on the website of our online shop in a manner enabling you to obtain, reproduce and record their content.

4. Delivery of products

In some cases, shipping costs must be added to the stated product prices. Ordered products are delivered by the courier companies we work with. Detailed information on the available methods and time limits of delivery and on shipping costs is presented during the ordering process and in a dedicated information tab on our shop's website.

As a rule, it is possible to collect products in person at: BADY, 05-220 Zielonka, Poniatowskiego 109, between 9:00 and 16:00

5. Payments

The following forms of payment are available to you in our online shop:

  • Cash on delivery upon receipt of the parcel.
  • Electronic payments (e-payments) via an online payment service.
  • Credit card payments: Via, Visa Electron, MasterCard, MasterCard Electronic
  • The entity providing online payment handling services is Autopay S.A.
  • Payment by traditional bank transfer to our shop's bank account. If this form of payment is selected – after the order has been placed, we will send you by e-mail the details required to make the transfer. Processing of the order will commence once the full amount due for the order placed has been credited to our account.

Detailed information on the available methods of payment, including the online payment services integrated with our shop and the available types of e-payments, as well as any additional costs, is presented during the ordering process and on our shop's website in a dedicated information tab concerning payment methods.

6. Right of withdrawal from the contract

Consumers have a statutory right to withdraw from the contract within 14 days of receiving the product, in accordance with the information contained in the notice on the right of withdrawal from the contract. The right of withdrawal from the contract also applies to natural persons concluding a contract directly connected with their business activity, where it follows from the content of that contract that it does not have a professional character for such persons, resulting in particular from the subject of the business activity they perform, as made available on the basis of the provisions on the Centralna Ewidencja i Informacja o Działalności Gospodarczej (Polish Central Register and Information on Business Activity).

7. Damage arising during transport

In the case of a consumer distance purchase, our shop always bears the risk of accidental damage to or loss of the goods in transport. If the ordered products are delivered with obvious damage arising during transport, we kindly ask you to report such a defect to the deliverer as soon as possible and to contact us. A delay in submitting such a complaint or in making contact has no consequences whatsoever for your statutory rights (described below in the section on complaints) and their satisfaction. A prompt report is, however, of assistance to us in pursuing our claims against the carrier or the transport insurer.

8. Complaints: conformity of the goods with the contract / defects

We are obliged to deliver goods free from defects. In the event of a lack of conformity of the goods with the contract, the Consumer is entitled to the rights set out in Chapter 5a of the ustawa o prawach konsumenta (Polish Consumer Rights Act). On the terms set out therein, the Consumer may demand repair or replacement of the goods which are not in conformity with the contract, or make a declaration on the reduction of the price of the goods, or withdraw from the contract.

We are liable for a lack of conformity of the goods with the contract which becomes apparent within 2 years of their delivery, unless we have specified a longer shelf life for the given goods – in which case that longer period applies.

In the event of a lack of conformity of the goods with the contract, the above provisions concerning the Consumer also apply to a natural person concluding a contract directly connected with their business activity, where it follows from the content of that contract that it does not have a professional character for that person, resulting in particular from the subject of the business activity they perform, as made available on the basis of the provisions on the Centralna Ewidencja i Informacja o Działalności Gospodarczej (Polish Central Register and Information on Business Activity).

The Seller will make the refund using the same methods of payment as were used by the Buyer in the original transaction, unless the Buyer agrees to another solution; in any event, the Buyer will not incur any charges in connection with this refund.

  • Complaints will be considered within 14 days.

Information concerning any additional guarantee and its detailed terms is always enclosed with the product and available on the information pages of the online shop.

9. Services provided by electronic means

In order to use our online shop, including to browse the range and place orders, it is necessary to have a multimedia device with an installed web browser and access to the Internet and to electronic mail. It is recommended that the browser settings enable support for JavaScript scripts and the saving of Cookies. Users are obliged to use the online shop in a manner compliant with the law and good practice; the supply of unlawful content is prohibited.

We take all necessary measures to ensure the fully correct operation of the website and interface of our online shop to the extent resulting from current technical knowledge, and we undertake to remedy within a reasonable period any irregularities and technical problems reported by users. The above also applies to the possibility of subscribing to the newsletter or the optional possibility of setting up a customer account – if such services are provided within our shop. You may notify us of any detected irregularities or interruptions in the functioning of the website and services of our online shop using the contact details indicated in the section above. In a complaint concerning irregularities relating to the technical functioning of the online shop's website, please indicate the type of irregularity and the date on which it occurred.

11. Out-of-court dispute resolution

We inform you that Consumers have the possibility of using out-of-court means of handling complaints and pursuing claims. Information on how to access the aforementioned procedure and dispute resolution procedures can be found at the following address: www.uokik.gov.pl in the tab "Amicable resolution of consumer disputes".

Moreover, at: http://ec.europa.eu/consumers/odr Consumers have access to the online platform for the resolution of consumer disputes (the so-called ODR platform). The ODR platform is a multilingual, interactive website serving Consumers and traders seeking the out-of-court resolution of disputes arising from the conclusion of a distance contract of sale or a contract for the provision of services.

Use of the aforementioned out-of-court means of pursuing claims and resolving disputes is voluntary and may take place only where both parties to the dispute (the Consumer and the seller) consent to it.

None of the provisions of these Terms and Conditions is intended to infringe the statutory rights of the Consumer. In the event of any inconsistency between the provisions of these Terms and Conditions and the rights of Consumers arising from generally applicable law, the statutory regulations shall always apply in place of the contested provisions of the Terms and Conditions.
